STUDENT CODE OF CONDUCT

( LA RS 17:416.13.A )

The LaSalle Parish School Board realizes, as a public agency, the school shares the responsibility with parents to educate, guide, and when necessary, discipline children.  Fair and impartial discipline will help to ensure that a proper climate for learning will exist, and it will also help students develop the self discipline that is required for learning.

The ultimate responsibility for student conduct rests with the student and his parent.  It is also the daily responsibility of school personnel to see that no single person interferes with the total learning environment of other students.  As prescribed by law, every teacher is authorized to hold every pupil to a strict accountability for any disorderly conduct in school or on the playground of the school or on any street, road, or school bus going to or returning from school, and during intermissions or recesses.  It is the final responsibility of the principal\designee to maintain discipline at each school or any school function or school-sponsored activities.  Referrals to the Courts, Families in Need of Services (F.I.N.S.), etc. may be made when a student’s behavior warrants such.

 MINOR OFFENSES

 When students commit minor offenses, the teacher should discipline the student according to their school discipline plan.  It is also recommended that the teacher contact, by phone or by sending home a note, the parents and inform them of the problems before referring the student to the Principal. In addition, the teacher may decide to administer punish work to the student. If punish work is issued, it should be in line with the offense.  

For minor offenses the Principal or his/her designee may, as deemed appropriate, use from a variety of disciplinary measures established by the school including but not limited to counseling with the student, referral to the guidance counselor or other appropriate counselor, or use corporal punishment (If this method is selected the principal shall abide by LaSalle Parish School Board regulations regarding corporal punishment.)

 For habitual minor offenses, the principal or his/her designee will contact the parent/guardian regarding behavioral concerns.

 The teacher shall refer students to the principal when necessary, using the School Behavior Report Form established by the State Department of Education.

Beginning with the 2006-2007 school year in grades K‑12, students shall respond to personnel using respectful terms ("Yes, Ma'am, Yes, Sir.") Violations shall be considered a minor offense and disciplined accordingly. (LA R.S. 17:416.12)

 MAJOR OFFENSES

 The Student Code of Conduct includes but is not limited to the following offenses and dispositions.  A student found in violation of the Student Code of Conduct shall be disciplined according to the disposition set forth for that offense or as deemed appropriate by the Principal or the Principal’s designee.

Prior to any suspension, the school principal or the principal’s designee shall advise the student in question of the particular misconduct of which he or she is accused as well as the basis for such accusation, and the student shall be given an opportunity at that time to explain his or her version of the facts to the school principal or his or her designee; however, a student whose presence in or about a school poses a continued danger to any person or property or an ongoing threat of disruption to the academic process shall be immediately removed from the school premises without the benefit of the procedure described above; however, the necessary procedure shall follow as soon as is practicable.

 Notice in writing using the School Behavior Report Form for Suspensions and Expulsions of the suspension and/or recommendation for expulsion shall be given to the parent or parents of the suspended student. (Bulletin 741, School Administrators Handbook) 

GRADES Pre-K through 5

 Elementary school principals, grades PreK‑5 may use, at their own discretion, any of the items under the Student Code of Conduct they feel appropriate. However, serious offenses such as the following should be dealt with decisively and with firmness and may result in suspension or expulsion:

 1.         Possession or use of weapons.

2.         Act of assault and battery upon faculty, school personnel, school official, or other

            student.

3.         Possession or use of illegal drug and/or alcohol or drug paraphernalia.

4.         Threatening school personnel/teacher, faculty, school official, or other student.

5.         Extreme Disrespect for authority

6.         Extreme Disobedience       

7.         Cursing faculty or school personnel

8.         Vandalism

9.         Extortion

10.       Inciting a riot

11.       Theft

12.       Sexual acts

13.       Violations that endanger health and safety of others.

7. USES/POSSESSES CONTROLLED DANGEROUS SUBSTANCES

Ø      Possession of illegal drugs, controlled substance, prescription medications, inhalants,  drug paraphernalia, or any mood-altering chemical while on school premises or school bus.

                                                           1)      Investigate. Notify law enforcement, superintendent, immediate supervisor, drug-free counselor and parents.  Suspend pending hearing. Recommend expulsion (LA R.S. 17:416 applies). Refer to substance abuse clinic and/or counselor.  Re-evaluate prior to re-admittance.  Complete & file documented steps. (Refer to LPSB Substance Abuse Policy for more details

                        2)  Investigate, determine if “under the influence”, if confirmed then: Notify

                                          law enforcement, superintendent, immediate supervisor, drug-free

                                          counselor, and parents.  Refer for testing.  Refer to Substance Abuse

                                         Prevention Team.  Suspend student pending hearing.  Recommend

                                         expulsion.  Refer to substance abuse clinic and/or counselor for

                                        assessment and/or counseling.  Re-evaluate prior to re-admittance. 

                                        Refer to Drug-Free Counselor for follow-up upon re-admittance.

Ø      Distribution, intent to distribute, or knowledge of either while on school premises or school bus.

1)     Investigate. Notify law enforcement, superintendent, Supervisor of Child Welfare & Attendance, drug-free counselor, and parents.  Suspend and immediately recommend expulsion (LA. R.S. 17:416 applies). Refer to substance abuse clinic and/or counselor for assessment and/or counseling. Re-evaluate prior to re-admittance. Complete and file documented steps. (Refer to LPSB Substance Abuse Policy for more details)

8.  USES/POSSESSES ALCHOLIC BEVERAGES                

Ø      Possession of alcohol while on school premises or school bus:

                                  1)  Investigate. Notify law enforcement, superintendent, immediate

                                       supervisor, drug - free counselor and parents.  Suspend pending hearing.

                                       Recommend expulsion. Refer to substance abuse clinic and/or

                                       counselor.  Re-evaluate prior to re-admittance.  Complete & file

                                       documented steps. (Refer to LPSB Substance Abuse Policy for more

                                       details)

Ø      Being under the influence of alcohol while on school premises or school bus:

                        1)  Investigate, determine if “under the influence” (see criteria in substance

                              abuse policy), if confirmed then:  Notify law enforcement, superintendent,

                              immediate supervisor, drug-free counselor, and parents.  Refer for

                              testing. Suspend pending Substance Abuse Prevention Team meeting

                              (SAPT will determine outcome and final disciplinary disposition).  Refer

                             to substance abuse clinic and/or counselor for assessment and/or

                             counseling, re-evaluate prior to re-admittance.  Refer to Drug-Free

                            Counselor for follow-up upon re-admittance.  Complete and file

14.  POSSESSION/USE OF *DANGEROUS WEAPONS OR AN OBJECT AS A WEAPON

1)  Notify parents, Contact Law Enforcement and superintendent.  Arrange Crisis 

      Management Team Meeting if deemed necessary.  Suspend and refer to

      LA. R.S. 17:416  for disciplinary action (see attached chart).

15.  THROWS MISSILES LIABLE TO INJURE OTHERS

            1)  1-3 days detention or 1-3 days suspension

2)  1-3 days suspension

3)  3-5 days suspension, Refer to Truancy/Discipline Court

4)  Suspend & recommend expulsion

16.  INSTIGATES OR PARTICIPATES IN FIGHTS

17. VIOLATES TRAFFIC AND SAFTEY REGULATIONS

           1)  1-5 days loss of driving privileges on school premises

18.  LEAVES SCHOOL OR CLASSROOM WITHOUT PERMISSION

            1)  1-3 days detention or 1-3 days suspension

19.  IS TARDY AND/OR ABSENT (excessive)

            2)  Notify Parents/Guardians by letter or phone at designated intervals of unexcused

                 absences.

            3)  Notify SCWA for excessive absences or concerns.

            4)  Refer to Truancy/Discipline Court when criteria is met for referral.

Ø      Excessive Tardies

            1)  Verbal Warning

            2)  1 day detention

            3)   2 days detention

            4)  1 day suspension, Notify Child Welfare & Attendance Supervisor

            5)  2 days suspension (if five within one month, refer to Truancy/Discipline Court )

            6)  3 days suspension

            7)   Refer to Truancy/Discipline Court for excessive tardiness.

20. IS GUILTY OF STEALING

            1)  1-3 days suspension, Refer to Counselor, Refer to Truancy/Discipline Court , Restitution

24.  THREATENING STUDENTS/FACULTY/SCHOOL PERSONNEL

Ø      All threats or threatening remarks will be taken seriously and shall be dealt

              with  accordingly.

1)  Notify parents, Contact Law Enforcement and Superintendent,  Arrange Crisis 

      Management  Team Meeting, Suspend pending Crisis Management meeting. 

      (Crisis Management Team will follow Crisis Procedure and determine outcome and

      final disposition.)

25.  SEXUAL HARRASSMENT (Student to Student or Student to Teacher)

Ø      Sexual harrassment will be taken seriously and shall be dealt with     

             accordingly.

1)     Principal or Designee will investigate in a discreet yet thorough basis and appropriate

      disciplinary  action shall be taken when violations of the policy have been determined.  

     This may  range anywhere from counseling to exclusion from school and may include

      other forms of disciplinary action as deemed appropriate under the circumstances.                  

      Referrals to the Law Enforcement and/or to the Crisis Management Team should be

      made as deemed appropriate and/or necessary.

26.  BULLYING, INTIMIDATION, HARASSMENT, AND/OR HAZING

Ø      All forms of harrassment will be taken seriously and shall be dealt with     

             accordingly.

1)      Principal or Designee will investigate in a discreet yet thorough basis and appropriate

      disciplinary  action shall be taken when violations of the policy have been determined. 

     This may range anywhere from counseling to exclusion from school and may include

      other forms of disciplinary action as deemed appropriate under the circumstances.                 

      Referrals to the Law Enforcement and/or to the Crisis Management Team should be

                 made as deemed appropriate and/or necessary.

27.  ASSAULT and/or BATTERY ON SCHOOL PERSONNEL or ANOTHER STUDENT

             1)  Notify Law Enforcement, parents, superintendent; Immediately suspend and

                  recommend expulsion. 

28.  RIOTS

Ø      Inciting a riot

            1)  Notify parents, Refer to Counselor, Refer to Truancy/Discipline Court , Refer to Law

                 Enforcement, Suspend and recommend expulsion.

Ø      Participating in a riot

            1)  5-9 days suspension, Refer to Truancy/Discipline Court

            2)  Suspend and recommend expulsion    

29.  SKIPPING SCHOOL (Never came on school grounds during normal school hours)

            1) Refer to Supervisor of Child Welfare & Attendance for truancy.

30.  INAPPROPRIATE OBJECTS POSSESSION and/or USE

 Including ipods, MP3 players, beeper, laser light, or other unauthorized electronic device    such as cameras, walkman, radios, tape recorders, etc. (not being used as instructional aids under supervision and with knowledge of the teacher and/or principal).
